This website, www.landlord.co.tz (the “Site”), is operated by Landlord Ltd (“we,” “us,” “our”). These Terms of Use (“Terms”) govern your access to and use of our Site and the services we provide, including property listings, investment opportunities, and related content (collectively, the “Services”).

By accessing or using our Site and Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Site or Services.

1. Definitions

“User,” “you,” “your” refers to any individual or entity that accesses or uses the Site.
“Listor” refers to a User who lists a property for sale, rent, or investment.
“Buyer/Tenant/Investor” refers to a User who uses the Site to find properties for purchase, rent, or investment.
“Content” includes all information, text, graphics, photos, logos, trademarks, property details, and other materials uploaded to the Site.

2. Services Offered

Landlord.co.tz is a platform that facilitates:
The listing and marketing of properties for sale and rent.
The listing and marketing of real estate development projects for investment.
Connections between Listors and potential Buyers, Tenants, and Investors.

We are not a real estate broker, agent, or investment advisor. We are a neutral venue. We do not own, sell, or lease the properties listed, nor do we endorse any specific investment opportunity. All transactions are solely between Users. We are not a party to any agreements entered into between Users.

3. User Accounts

Eligibility: You must be at least 18 years old and have the legal capacity to enter into binding contracts to create an account.
Accuracy: You agree to provide accurate, current, and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Verification: We reserve the right to approve, reject, or suspend any account at our sole discretion.

4. Listors' Responsibilities

If you list a property or project on the Site, you represent and warrant that:
You own the property/project or have all necessary legal authority (e.g., as a legally appointed agent) to list it for sale, rent, or investment.
All information you provide is accurate, truthful, and not misleading.
You have the right to use and publish all images and content you upload.
You will not list fraudulent, fake, or non-existent properties.
You will deal with inquiries professionally and in good faith.
You are solely responsible for complying with all applicable Tanzanian laws, including those related to property ownership, sales, rentals, and financial investments.

5. Buyers/Tenants/Investors' Responsibilities

Due Diligence: You are solely responsible for conducting your own due diligence before entering into any transaction. This includes, but is not limited to:
Verifying the ownership, legal status, and condition of a property.
Independently assessing the viability and risks of any investment project.
Consulting with qualified professionals (e.g., lawyers, surveyors, financial advisors).
Binding Agreement: Any agreement you enter into with a Listor is a binding contract between you and them. We are not responsible for the terms or performance of such agreements.

6. Prohibited Activities

You agree not to:
Use the Site for any illegal or unauthorized purpose.
Post false, inaccurate, or misleading content.
Harass, intimidate, or harm other Users.
Use the Site to distribute spam or unsolicited commercial communications.
Impersonate any person or entity.
Use any robot, spider, or other automated means to access the Site for any purpose without our express written permission.
Interfere with or disrupt the integrity or performance of the Site.

7. Intellectual Property

The Site and its original Content (excluding User-generated Content), features, and functionality are and will remain the exclusive property of Landlord Ltd and its licensors. Our trademarks and trade dress may not be used without our prior written consent.

You retain ownership of the Content you post. However, by posting Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that Content in connection with the Services.

8. Fees and Payments

Some Services may be subject to fees (e.g., listing fees, premium subscriptions). All fees will be clearly displayed, and you agree to pay all applicable fees.
Fees are non-refundable unless otherwise stated in a separate refund policy.
We reserve the right to change our fees at any time, with reasonable notice.

9. Disclaimer of Warranties and Limitation of Liability

“As Is” Basis: The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties of any kind, whether express or implied.
No Endorsement: We do not endorse any User or property listing. We do not verify the accuracy of User-generated Content.
Limitation of Liability: To the fullest extent permitted by law, Landlord Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Services; (b) any transactions between Users; (c) any unauthorized access to or use of our servers; or (d) any conduct or content of any third party on the Site.
Your sole and exclusive remedy for dissatisfaction with the Site is to stop using it.

10. Indemnification

You agree to indemnify and hold harmless Landlord Ltd and its affiliates, officers, agents, and employees from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania.
Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiations. If unresolved, the dispute shall be submitted to the courts of the United Republic of Tanzania for resolution.

12. Modifications to the Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by posting the new Terms on the Site and updating the “Last Updated” date. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.

13. Termination

We may suspend or terminate your account and access to the Site at any time, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account.
